Terms of Service

For decades, Craftmaster Enterprises has been providing information and services to individuals and businesses. We're thankful to have you as a Customer, and will do our best to help you succeed in your business or individual endeavors. We make every effort to provide you with complete, accurate, up-to-date information and work hard on your behalf to ensure an enjoyable and profitable experience for all. There are some important things you need to know regarding our services, as listed below. IMPORTANT, PLEASE READ THE BELOW AGREEMENT AND LEGALLY BINDING CONTRACT.

1. Terms of Service Craftmaster NewsTM(CraftmasterNews.com), Art & Craft Show Yellow PagesTM(ArtsCraftsShowBusiness.com, CraftShowYellowPages.com, SmartFrogs.com), The Crafts Fair GuideTM(CraftsFairGuide.com), and data provider ShowListerTM (hereby referred to as "The Sites") are online information services provided by Craftmaster EnterprisesTM. These terms and conditions ("Terms of Service" or "Agreement") govern your access to and use of The Sites. By accessing or using The Sites, you are agreeing to the Terms of Service and concluding a legally binding contract with Craftmaster Enterprises. From time to time, we may modify the Terms of Service without specific notice to you, and such modifications shall become effective immediately upon posting the modified Terms of Service to The Sites. YOU MAY NOT USE OR ACCESS THE SERVICE IF YOU ARE UNWILLING TO BE BOUND BY THE TERMS OF SERVICE.

2. Definitions. "The Sites" refers collectively to any and all websites owned and maintained by Craftmaster Enterprises as indicated, but not limited to, Section 4 of these Terms of Service. "The Service" refers collectively to any and all services offered by The Sites. "You", "Your", and "The Customer" refer to you, as a user of The Service. "Your Content" refers to any content posted or submitted by you.  "We", "Us", and "Our" refer to Craftmaster Enterprises.  "The Agreement" refers to these Terms of Service. "The Software" refers to all software and source code utilized within The Sites.

3. Copyright. Unless otherwise indicated, the entire contents of The Sites are copyrighted by Craftmaster Enterprises. ALL RIGHTS RESERVED. No part of any pages on The Sites (either text, image, code or software) may be used for any purpose other than your non-commercial, private use unless expressed in writing by Craftmaster Enterprises. Our copyrights are protected by international copyright and trademark laws, including the U.S. Copyright Act, the Computer Fraud and Abuse Act, the Digital Millennium Copyright Act, The Piracy and Counterfeiting Amendments Act, and The No Electronic Theft Act (NET), and other international copyright and trademark laws. The owner of the copyrights and trademarks of The Sites are Craftmaster Enterprises and its affiliates or licensors. Our copyrights ALSO include any information that may not specifically display the © symbol as specified in the Berne Convention international agreement. YOU MAY NOT COPY, REPRODUCE, REPUBLISH, TRANSMIT OR DISTRIBUTE IN ANY MANNER, ANY CONTENT ON THE SITES, INCLUDING ANY AND ALL TEXT, GRAPHICS, CODE OR SOFTWARE, without the expressed written permission from Craftmaster Enterprises. ALL RIGHTS RESERVED. Copyright Infringement is a serious civil and/or criminal offense under Section 506 et seq. of the U.S. Copyright Act, and punishable statutory and actual damages range up to $150,000 in fines, per instance. Our Legal Department is aggressive in defending our Company's copyrights and Software License Agreements. Service Marks Craftmaster NewsTM (www.CraftmasterNews.com), Art & Craft Show Yellow PagesTM (www.craftshowyellowpages.com, www.artscraftsshowbusiness.com, www.smartfrogs.com), The Crafts Fair GuideTM (www.craftsfairguide.com), and ShowListerTM www.showlister.com), are our service marks or registered trademarks. Use of any of our service marks or registered trademarks, including but not limited to any and other service marks held by Craftmaster Enterprises, is strictly prohibited without the expressed, written consent of Craftmaster Enterprises.

5. License Grant.Subject to the terms of the Agreement, Craftmaster Enterprises hereby grants you a non-exclusive, non-transferable, revocable license to access and use the information in The Sites solely for your non-commercial use strictly within the accordance of The Agreement. You do not acquire any intellectual property rights to Craftmaster Enterprises data, arrangement of data, documentation or other materials. All such rights and interests remain in Craftmaster Enterprises and its licensors without the expressed unless explicitely granted via written permission or separate license agreement by Craftmaster Enterprises.

LIMITED LICENSE: You may print information from The Sites for internal, personal, non-commercial purposes provided you maintain all copyright information therein. You may not remove, change, or obscure any copyright notice contained on any page within The Sites, and any information that may not specifically display the © symbol remain the exclusive intellectual property of Craftmaster Enterprises.

NO REDISTRIBUTION: Craftmaster Enterprises grants you the license to access and use the information in our database for your personal, non-commercial use. You may not copy, duplicate, or otherwise replicate our information either via manual or automated means, and you explicitly agree to be bound by these terms. Any use of our software or information contained with The Sites outside of the terms of your license grant will be considered a violation of the Software License Agreement, and an infringement upon Craftmaster Enterprises' copyrights pursuant to Section 2319 of title 18 [18 USCS Sec. 2319] of the U.S. Copyright Act, Section 501 et seq. of the U.S. Copyright Act, and the Digital Millennium Copyright Act of 1998.

6. Registration. Certain sections of The Sites require that you register and/or purchase a subscription to access information. You are responsible for maintaining the confidentiality of your account password upon registration. You are also responsible for any activities that occur in connection with your account, and you agree to notify us immediately of any unauthorized use of your account. YOU AGREE THAT YOU WILL PROVIDE YOUR REAL NAME AND ACCURATE INFORMATION, INCLUDING YOUR POSTAL MAILING ADDRESS, TELEPHONE CONTACT INFORMATION, EMAIL ADDRESS, and any and all other information required on our registration forms. Your registration does not allow access through any other entity than yourself, and registration specifically does not allow access through multiple users on any network, organization, or other entity. Each registration is for your personal, non-commercial use, and may ONLY be on behalf of any other person or entity with the expressed, written permission from Craftmaster Enterprises. We reserve the right to close your account at any time for any or no reason.

7. Auto-Renew Subscriptions. Craftmaster Enterprises does NOT auto-renew subscriptions to use its software or products, unless specifically requested to do so by you via a separate agreement. At the term of any purchased subscription to access information, it is your responsibility to renew your subscription and software license. You will agree to be bound by the terms of the current license agreement at the time of renewal as a separate license agreement. Subscription terms to The Service are for 1 year, 2 years, or 3 years from the date of purchase, and are calculated by adding 365 days for each year purchased to the date of purchase.

8. Guarantee/Warrantee. You agree that our guarantee and warranty is for 30 days within the date of purchase of any services, including subscriptions to either print publications or online website access. Refund requests for any purchases or subscriptions must be made within 30 days of purchase, otherwise they will only be honored in the form of subscription credit.

9. Site Availability. We make every effort to keep The Sites running at all times, however services may be modified, interrupted, suspended or discontinued at any time without notice or liability.

10. Content. You alone are responsible for Your Content, and once published, it cannot always be withdrawn. We make every effort to maintain up-to-date, accurate information, but are not responsible for any content deemed incorrect, inaccurate or unreliable. You represent that you own, or have the necessary permissions or rights to use, publish, or authorize Your Content. You may not imply that Your Content is expressly endorsed by Craftmaster Enterprises without the expressed, written permission.

11. Linking to any of The Sites. You may provide website links The Sites, or any information contained within The Sites, provided that you do not remove any Copyright or other notices, and that you agree to discontinue any links to The Sites immediately at Craftmaster Enterprises' request.

12. Links to other Websites. The Sites may contain links to other websites and other Internet content. We are not responsible for the content, accuracy or opinions expressed on other sites. Inclusion of any linked website from The Sites do not imply approval or endorsement by us. Use at your own risk, and report any links to other websites, content, or any other information you feel is inappropriate, inaccurate, or otherwise unreliable information to: Legal@CraftmasterNews.com.

13. Advertisers, Event Listings, and 3rd Party Content. The Sites may contain information from advertisers and sponsors. All advertisers and sponsors are solely responsible for the accuracy, validity, or legality of any inclusion in The Sites. You agree that The Sites are not responsible for any accuracy, validity, or illegality that may arise from our advertisers or any other entity. We do not guarantee the accuracy or validity of any information posted on The Sites by third party providers or ourselves. We make every good faith effort to verify any and all information posted on The Sites, but do not represent or warrant that the information available will be correct, accurate, or otherwise reliable. Use at your own risk, and report any links to other websites, content, or any other information you feel is inappropriate, inaccurate, or otherwise unreliable information to: Legal@CraftmasterNews.com.

INDEMNIFICATION: You agree to indemnify, defend and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, attorneys, advertisers, product and service providers, harmless from any liability, loss, claim and expense, related to any information posted on The Sites OR within our print publications.

DATA ERRORS, CORRECTIONS, AND CHANGES: We do not represent or warrant that data within The Sites will be error-free, correct, accurate, or reliable information. We reserve the right to investigate, correct, change, or update any and all information available through The Sites. To report any inaccuracies or other information you feel is incorrect, please email: Info@CraftMasterNews.com. REFUSAL OF SERVICE: We reserve the right to refuse service to anyone, for any or no reason, including but not limited to any event listings, advertisements, or subscriptions to access The Service.

14. Event Reviews and Message Posts. Some sections of The Service allow Customers to post reviews, messages, and other content. We may use Your Content in a number of different ways, including publicly displaying it, reformatting it, incorporating it into advertisements and other works, creating derivative works from it, promoting it or distributing it. As such, you hereby grant us world-wide, non-exclusive, royalty-free, sublicensable, irrevocable transferable rights to use Your Content for any purpose. By posting or submitting information to The Sites, you irrevocably waive, and cause to be waived, against Craftmaster Enterprises and its users any claims or assertions with respect to Your Content.

15. Privacy. You represent that you have read and understood our Privacy Policy. Please note that we may disclose information about you to third parties if we have a good faith belief that such a disclosure is reasonably necessary to (i) take action regarding suspected legal activities; (ii) enforce or apply our Terms of Service and Privacy Policy; (iii) comply with legal process or other government inquiry, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; or (iv) protect our rights, reputation, and property, or that of our users, affiliates, advertisers or sponsors, or the public. If you use The Service outside of the United States, you consent to having your personal data transferred to and processed in the United States.

16. Unlawful Activity. We reserve the right to investigate complaints or reported violations of The Agreement and to take any action we deem appropriate, including but not limited to reporting any and all suspected activities to law enforcement agencies, officials, regulators, or other third parties. We collect information including your name, physical mailing address, email address, telephone contact information, and track usage history, posted materials, IP address, website traffic information, and other information. Such information is used in accordance with our Privacy Policy.

17. Restrictions.
You agree not to, and will not assist or enable others to use The Service to:
    i. Violate our Privacy Policy;
    ii. Violate any 3rd party's rights, including copyright, trademark, patent, trade secret, or any other intellectual property or proprietary right;
    iii. Sent bulk emails, surveys, or other mass messaging, whether commercial in nature or not, or engage in any otherwise attempt to manipulate The Service
    iv. Solicit personal information from minors or transmit pornography, as in accordance with our Privacy Policy.
    v. Violate any applicable law.
You also agree not to, nor assist or enable others to:
    i. Violate the Terms of Service;
    ii. Reverse engineer any portion of The Service;
    iii. Remove or modify any copyright, trademark, or other notice that appears on any portion of The Service or any materials printed or copied from The Service;
    iv. Reformat any portion or frame of The Service;
    v. Take any action that imposes, or may impose, at our sole discretion, any unreasonable or disproportionately large load on Craftmaster Enterprises infrastructure or otherwise make excessive traffic demands of The Service;
    vi. Attempt to gain unauthorized access to The Service, user accounts, computer systems or networks connected to The Service through hacking, password mining or any other means;
    vii. Attempt to reverse engineer, decompile, or disassemble any part of The Software or The Service
    viii. Use any automatic or manual process to harvest information from The Sites, or use The Sites for the purpose of gathering information for transmitting unsolicited commercial email, unsolicited telephone calls or facsimile transmissions, or unsolicited mailings, or use The Sites in any manner that violates any State or Federal laws regulating email, facsimile transmissions or telephone solicitations.
    ix. Use The Sites to export or re-export The Sites or any portion thereof in violation of export control laws or regulations of the United States, without the expressed, written permission from Craftmaster Enterprises.

18. Termination. You may terminate the Terms of Service at any time by closing your account, discontinuing your use of The Service, and providing Craftmaster Enterprises with a notice of termination by emailing Subscriptions@CraftmasterNews.com, or by certified USPS mail to: Craftmaster Enterprises, P.O. Box 39429, Downey, CA 90239. If your account is closed, we may continue to display any content you have posted, with or without your consent. We may close your account, suspend your ability to use certain portions of The Service, and/or ban you altogether from The Service for any or no reason, and without notice or liability of any kind. In any event of any termination, whether by you or us, any and all Sections of these Terms of Service will continue in full force and effect for the period of time you agreed to the Terms of Service.

19. Governing Law. California law will govern these Terms of Use, as well as any claim, cause of action or dispute that might arise between you and Craftmaster Enterprises, without regard to conflict of law provisions. FOR ANY CLAIM BROUGHT BY EITHER PARTY, YOU AGREE TO SUBMIT AND CONSENT TO THE PERSONAL AND EXCLUSIVE JURISDICTION IN, AND THE EXCLUSIVE VENUE OF, THAT STATE AND FEDERAL COURTS LOCATED WITHIN LOS ANGELES COUNTY, CALIFORNIA.

20. ALL RIGHTS RESERVED.
    i. We reserve the right to modify, update, or discontinue The Service at our sole discretion, at any time, for any or no reason, and without notice or liability. We may provide you with notices, including any and all regarding changes to the Terms of Service by email, USPS mail, or other communications through The Sites.
    ii. The Terms of Service contain the entire agreement between you and Craftmaster Enterprises regarding the use of The Service, and supersede any prior agreement between you and us on such subject matter. You agree that no reliance is placed on any representation made but not expressly contained in these Terms of Service.
    iii. Any failure on Craftmaster Enterprises' or your part to exercise or enforce any right or provision of the Terms of Service does NOT constitute any waiver of such right or provision. If any provision of the Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms of Service shall otherwise remain in full force and effect and enforceable.
    iv. The Terms of Service are not assignable, transferable, or sub-licensable by you without the expressed, written consent of Craftmaster Enterprises, but may be assigned or transferred by us without restriction. Any assignment to be made in violation of the Terms of Service shall be void.
    v. Any rights not explicitly stated in these Terms of Service are hereby reserved. ALL RIGHTS RESERVED.
